Teksten fins i original på papir i DRA (Sverige gl. nr. 41), og i en vidisse av 11. sept. 1425 (jfr. NgL 2. R. I s. 36 f.) . Her trykt etter NgL 2. R. I nr. 22. Også trykt ST II s. 563-67. Bare 10 av de 17 sigillantene som er nevnt, har virkelig beseglet, og seglene er trykt på brevet, mens teksten forutsetter at de skulle henges ved. Dette viser at det må ha vært meningen at brevet skulle få sin endelige utforming på pergament, som var det vanlige materiale for traktater. Man mente tidligere at ingen nordmenn hadde beseglet brevet, men N. Skyum-Nielsen har påvist at dette ikke er helt sikkert (Scandia 26 s. 1-40).
    Brevets utstedelsesdato, margaretamessedag, kan i de middelalderske kalendariene være både 13. og 20. juli (jfr. L. Gjerløw: KLNM VIII sp. 140). Forskningen har vanligvis holdt på 20. juli, bl. a. fordi hyllingsbrevet fra Kalmarmøtet (nr. 101) er utstedt 13. juli, betegnet som "fredag før knutsmesse" (jfr. P. A. Munch: NFH Un.per. II s. 385 n. 1). Men Ordinarius Lincopensis fra tidsrommet 1391-1406, som gjaldt for I,inkoping bispedømme, der Kalmar lå, har 13. juli (S. Helander: Ordinarius Lincopensis, 1957 s. 377, jfr. s. 46; J. Schreiner: SHT 1951 s. 261 f.).
    Unionsmøtet i Kalmar 1397 cr kanskje den mest omdiskuterte enkelthending i nordisk historie, først og fremst p.g.a. unionsbrevet. Diskusjonen har både dleid seg om brevets rettsgyldighet og om den politiske bakgrunn for det. De som regner brevet for et rettsgyldig dokument, mener at dets ufullkomne form kan forklares ved at det er et vitnebrev om en muntlig avtale som har funnet sted, ikke en egentlig traktat, og peker dessuten på at det senere, både av Erik av Pommern og aristokratiet, ble regnet som rettsgyldig. Tilhengerne av den motsatte oppfatning mener at det er et utkast til en avtale som har strandet på motstand enten fra dronning Margareta, fra aristokratiet eller fra nordmennene. Den mest utbredte oppfatning i dag er antagelig den som ble fremsatt av E. Lönnroth i 1934 at unionsbrevet er uttrykk for stormennenes ønske om en union bundet sammen av en svak kongemakt der de selv skulle dominere (regimen politicum) og at det på grunn av motstand fra dronning Margareta ikke er blitt gyldig avtale. Hyllingsbrevet er derimot et resultat av dronningens ønske om en sterk kongemakt (regimen regale).
